I make the above statements and voluntarily enter into this agreement to provide a temporary home as a foster caregiver to any animal(s)(s) (TLC K9 Rescue) may temporarily place in my care.
I agree to provide (TLC K9 Rescue) or representatives access to all parts of my home and property for a home inspection before my application to foster is approved.
I understand that I may be required to provide foster care to my foster animal(s)(s) for an extended and indefinite period of time.
I agree that I am over 21 years of age.
I understand that (TLC K9 Rescue or it's representatives) provides no guarantee as to the health of my foster animal(s)(s) and that my foster animal(s)(s) may have medical needs, socialization problems, and may not be housebroken.
I agree to provide my foster animal(s)(s) with veterinary care as authorized by (TLC K9 Rescue and it's representatives), I will not arrange or pay for any elective veterinary care for my foster animal(s)(s) without the express consent of TLC K9 Rescue or authorized representative.
If the animal(s)(s) is not spayed or neutered, I will take all necessary precautions to prevent my foster animal(s)(s) from either impregnating another animal(s)(s) or becoming impregnated. In the event that happens, I will notify (TLC K9 Rescue or it's representatives immediately.
I understand that I may only have my foster animal(s)(s) temporarily and must surrender my foster animal(s)(s) immediately upon request by TLC K9 Rescue or its representatives.
I agree that I am fostering this animal(s)(s) for (TLC K9 Rescue), and that I do not have any right of ownership over my foster animal(s)(s). I further agree that (TLC K9 Rescue's) rights to my foster animal(s)(s) are superior to mine. I also agree to provide (TLC K9 Rescue) or representative access to my home and property to check on my foster animal(s)(s), at any time that I am in possession of my foster animal(s)(s).
I agree to immediately return any foster animal(s)(s) in my care to (TLC K9 Rescue's) request or authorized representative at any time and for any reason. If (TLC K9 Rescue) is forced to undertake legal action to enforce this provision of the agreement, I agree to indemnify (TLC K9 Rescue) for all court costs and attorneys fees connected with such an action.
If I am planning to move at any time during the period when I am housing a foster animal(s), I agree to contact (TLC K9 Rescue) prior to my move and provide (TLC K9 Rescue) with my new address and contact information. I understand that (TLC K9 Rescue) has the right to request return of my foster animal(s)(s) based on my change of residence, and agree that I will surrender my foster animal(s)(s) to (TLC K9 Rescue) or representative immediately upon request.
I understand that as long as I provide foster care to my foster animal(s) to TLC K9 Rescue's satisfaction, I will be given the first right of adoption of my foster animal(s)(s), at such time as (TLC K9 Rescue) decides to place my foster animal(s)(s) for adoption (TLC K9 Rescue Makes No Guarantees)
If at any point i can no longer, or do not want to continue to provide care and shelter for my foster animal(s), I agree to contact (TLC K9 Rescue or it's representatives and arrange for surrender and return of my foster animal(s) back to (TLC K9 Rescue).
I will not transfer possession or custody of my foster animal(s)(s) to any other person at any time, except for temporary, short-term possession for the purpose of vet care, grooming, etc.
I agree to contact (TLC K9 Rescue) with any and all questions or concerns about my foster animal(s)(s) or the Foster Care Program as well as with updated contact information.
I agree that if I refuse or fail to comply with any provision of this agreement, (TLC K9 Rescue) has the right to terminated this agreement and also has the right to the immediate surrender and return of my foster animal(s)(s). I further consent to provide (TLC K9 Rescue) access to my premises if necessary to facilitate the return.
No Warranty: (TLC K9 Rescue), or representatives makes no warranty as to the temperament or physical condition of the foster animal(s)(s). The animal(s)(s) Is being fostered as is.
Special Disclaimer: All warranties with regard to foster animal(s)(s), including any implied warranty of merchantability and fitness for a particular purpose, where they are applicable, are hereby specifically disclaimed.
Release & Indemnification/No Liability: Foster hereby releases (TLC K9 Rescue), it's representatives, and family from any and all liability for personal injury, property damage, legal fees, or veterinary care, or any other expense or liability incurred by foster animal(s)(s) as a result of foster animal(s)(s). Foster agrees to indemnify TLC K9 Rescue from any and all such claims and to pay, without limitation, any costs related to such injury, damage, or liability, including, in the case of litigation, any attorney’s fees incurred by (TLC K9 Rescue), representatives and family in their defense.
Breach of Agreement/Liquidated Damages. In the event that you do not comply with the terms of this Agreement, or the foster animal(s)(s) is abused or neglected, we hold the right to recover the foster animal(s)(s) from you upon demand, and the foster animal(s)(s) will be surrendered to me immediately. In addition, without waiving any of my rights under this Agreement, if you do not surrender the foster animal(s)(s) to me, you will owe TLC K9 Rescue a payment in the amount of $5,000.00 agreed between us as just and reasonable liquidated damages to compensate us for our costs and expenses in connection with your breach of this Agreement and TLC K9 Rescue reserve it's rights to reacquire the foster animal(s)(s). I agree that the opportunity given to me to help rehabilitate my foster animal(s)(s), as well as the chance of a potential future adoption, is of significant benefit to me, and serves as first consideration in exchange for my agreement to the terms of this contract.
